Judiciary Committee approves immigration language in budget blueprint

On Monday, September 13, in a 14-hour session, the House Judiciary Committee approved the immigration language used in Biden’s 2022 budget package.

In other words, the Judiciary Committee gave the green light for the Biden administration to open a path to citizenship for undocumented essential workers through the immigration resolution included in the budget bill, which is being introduced through the reconciliation process.

The Biden administration moves forward on immigration reform

Since the beginning of the year, the White House has pushed Congress to enact the first comprehensive immigration reform in decades. However, in light of the surge of illegal border crossings, this request is currently stalled.

Therefore, the Biden administration decided to include an immigration resolution in the Democratic budget package for 2022, which includes:

  • Increasing border surveillance through technological routes to curb mass irregular migration without overburdening border agents.
  • Boosting the national economy through a path to legalization for approximately 8 million undocumented essential workers, including Dreamers (young immigrants who came to the country as children), farmworkers, and beneficiaries of TPS (Temporary Protected Status) and other humanitarian programs.
  • Improve the local immigration system and existing legal processes.

Biden’s budget package has already passed the US House of Representatives and the Senate Parliamentarian recently heard arguments on this $3.5 trillion proposal, who has yet to rule on it.

The reconciliation process appears to be the best alternative for Biden

The Biden administration knows that it is quite difficult to get bipartisan support in Congress at this time and that is why it decided to introduce its budget package through the reconciliation process, which would subtly promote immigration reform.

Broadly speaking, the budget reconciliation process allows the Biden administration to circumvent the Republican filibuster in the upper chamber of Congress, the Senate. Through this option, the budget package could pass with as few as 51 votes, instead of 60, which is the regular process and would be practically impossible at this time.

Clearly, tension and uncertainty are growing among immigrant communities in the US, who are hoping for more benefits after four years in which the Trump administration significantly narrowed the alternatives available to them.
